Acceptance and eligibility

These Terms of Service (“Terms”) represent a legally binding agreement between you and Ecommerce Scale Inc. (“Patriot Merch,” “we,” “us,” or “our”) governing your access to and use of the Patriot Merch website, educational articles, and online apparel store.

By browsing our website or purchasing products from our store, you agree to be bound by these Terms. If you do not agree to these Terms in full, you must not use our website or purchase items from our store. You must be at least 18 years old or the legal age of majority in your jurisdiction to make purchases on Patriot Merch.

Informational and educational disclaimers

Patriot Merch publishes historical articles, civic summaries, and guides covering topics such as the United States Flag Code, the Gadsden flag, and patriotic holidays. These materials are provided for general educational and informational purposes only.

  • No legal advice: Our articles explaining the United States Flag Code (Title 4 of the United States Code) and historical civic topics provide general cultural education and do not constitute formal legal counsel.
  • No government affiliation: Patriot Merch is an independent private brand. We are not affiliated with, endorsed by, or operated by the United States government, the Department of Defense, or any military service branch.

Store orders, pricing, and cancellation policy

When you purchase apparel or headwear from our store, the following commercial conditions govern the transaction:

  • Made-to-order manufacturing: Our t-shirts, hoodies, hats, and stickers are manufactured on demand by our production partner, Printful. Orders are sent to Printful and confirmed for production automatically as soon as payment succeeds.
  • Order changes and cancellations: If you need to change or cancel, email us right away at [email protected] with your order number. We can change or cancel only until Printful starts making it, which can be within a few hours; after that we can’t stop it.
  • Pricing errors: In the event that a product is mistakenly listed at an incorrect price due to a typographical or system error, we reserve the right to cancel the order and provide a full refund.
  • Domestic delivery: We manufacture and ship exclusively to addresses within the United States.
  • Returns and refunds: Because items are custom printed on demand, we do not accept returns or exchanges for buyer’s remorse or wrong size selection. Please verify your measurements on our apparel size guide before purchasing. If an item arrives damaged, defective, or misprinted, we provide a free replacement or refund when reported within 30 days of delivery, as detailed in our returns policy.

Intellectual property and acceptable site use

All website content, including article text, historical guides, graphics, garment design typography, software code, and logo marks, is the exclusive intellectual property of Ecommerce Scale Inc. and is protected by United States and international copyright and trademark laws.

You may not scrape, copy, reproduce, or redistribute our written content or apparel designs without prior written permission. You agree not to interfere with website operations, attempt unauthorized server access, or submit abusive inquiries through our contact page.

Limitation of liability

To the maximum extent permitted by applicable law, Ecommerce Scale Inc., its officers, directors, employees, and fulfillment partners shall not be held liable for any indirect, incidental, special, consequential, or punitive damages arising from your access to, use of, or inability to use our website or products.

Our total aggregate liability to you for any claim arising out of these Terms or your use of the website shall not exceed the greater of fifty United States dollars ($50) or the amount you paid to us for the specific product purchase giving rise to the claim.

Governing law and jurisdiction

These Terms and any dispute arising from your use of Patriot Merch shall be governed by and interpreted under the laws of Minnesota, without giving effect to any conflict of law principles. Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the state or federal courts located within Minnesota.

Changes to these terms

We reserve the right to update these Terms at any time. When modifications occur, we will update the effective date at the top of this document. Your continued use of our website or placement of store orders after such changes constitutes your acceptance of the revised Terms.
